Is THCa Legal in North Carolina Right Now? (June 2026 Update)
Short answer: Yes, fully. North Carolina is currently one of the friendliest THCa states in the country. The catch is the expiration date hanging over it.

Why NC is the easy one (for now)

North Carolina runs on the classic 2018 Farm Bill standard, written into state law by SB 455 back in 2022: as long as the product comes from hemp under 0.3% delta-9 THC on a dry weight basis, it's legal to buy, sell, and possess. Delta-9 only. No total THC math, no flower ban, no special permit hoops for buyers.

That's why so many THCa vendors operate out of NC and why selection there is excellent. Flower, concentrates, carts, all of it moves freely under current state law.

The clock: November 12, 2026

Here's the part nobody should ignore. The federal hemp redefinition (H.R. 5371) takes effect November 12, 2026. It moves the federal standard to total THC, counting THCa, with a cap of 0.4 milligrams per container. Essentially no real THCa flower passes that.

When that hits, NC's friendly state law stops mattering for most products, because the products will no longer be federal hemp in the first place. Unless Congress moves again or the courts block it, this November is the wall.

What the NC legislature is doing about it

Two bills worth knowing:
  • HB 607 would build a state regulatory framework that might preserve some access. Its future is unclear.
  • HB 328 goes the other way: it would ban THCa, delta-8, and HHC while setting up a licensed retail system with steep fees. It's currently stalled in the House Rules Committee.

So the state could land anywhere from "regulated but alive" to "banned like Tennessee." Nothing has passed yet.

TLDR

  • November 12, 2026 federal change threatens most products nationwide, NC included
  • State bills are in play that could soften or worsen the landing
