Short answer: Yes, for now, but it's complicated.
You may possess THCa products.
Retail availability is currently inconsistent across Texas, with some shops pulling products and others continuing sales depending on how they interpret current enforcement risk.

Here's the quick rundown of what's been going on.

Texas DSHS adopted a new rule that redefined acceptable THC levels to include both Delta-9 and THCa in the 0.3% calculation, which effectively banned smokable hemp flower statewide.
That rule took effect March 31, 2026.

So for a little while, THCa was basically banned in Texas. Then the courts stepped in.
On May 1st, a Travis County judge granted a temporary injunction blocking Texas health officials from enforcing that new standard while a lawsuit plays out.
THCa flower, pre-rolls, and concentrates went back on shelves.

On May 7th, the state of Texas filed an appeal to that temporary injunction. The current injunction runs through at least July 27, 2026, when trial is set.

As of June 5, 2026, THCA flower, pre-rolls, and concentrates are once again illegal to sell at Texas retail. The Texas 15th Court of Appeals issued a new order dissolving the temporary court protection that had kept smokable hemp products on shelves since May. Texas hemp businesses are required to pull THCA products from store shelves again.

The battle for retail sales is on, once again.

There's also a bigger federal issue coming up, H.R. 5371 was signed into law and takes effect November 12, 2026, which rewrites the federal hemp definition in a way that removes the legal protection most THCa products have relied on since 2018.
